Lawmaker wants marriage breakers to pay out


PEOPLE who form extramarital relationships and break up marriages should have to pay compensation to the innocent spouses, a lawmaker has suggested.

Ma Lan, a delegate to the ongoing 11th National People's Congress in Beijing and a scholar with Fudan University, has proposed amendments to the current marriage laws. She is dean of Fudan's Institute of Brain Science.

"The law should give victims the right to demand compensation from the adulterers who caused their divorces to curb these immoral extramarital relationships," Ma said.

In the amendments, Ma also suggests changes to the law concerning couples who live together but are not married.

Currently these relationships are considered illegal and are not protected. Courts usually reject cases involving these couples, Ma said.

But unmarried couples pose fewer social problems than the married people with lovers, Ma said. Their relationships should be legally protected, she said.

In disputes over property, the law should see unmarried couples share the property equally if there were no property agreements, Ma suggested.
